    There is a matter currently before the Family Court where an order was made in 1993 to transfer property to the adult children of the parties with a life estate to be given to the husband. The property was never transferred to the children and the husband has now passed on.

    The children are now seeking to enforce that order in the Family Court against the husband’s estate and require the husband’s executors to sign the necessary documents.

    The husband’s executors are resisting the application.

    We are seeing now more and more crossover between family law and estate law both in planning for the future and in possible litigation.

    It is imperative that people seek advice in relation to their financial affairs on a regular basis and that their Wills are current.
