It has been a while since my last blog but I have been up to a few things which I will share with you over the next few weeks.

Imagine a world where clients and lawyers sit together around a table to cooperate and assist each other (including the lawyers) to resolve parties’ differences.

Well, I am now qualified to do just that. I have recently undertaken a course with Queensland Collaborative Law where as lawyers we are shown a new way of assisting people to find a settlement

In a nutshell it requires everyone involved in the process including clients and lawyers to sign an agreement whereby they will cooperate and assist each other even if they see a mistake being made.

If parties change their mind and want to go to Court then the lawyers who are engaged must be sacked and new lawyers engaged to take the matter to Court. This would result in both parties suffering financial and emotional cost. A great incentive for both parties to continue negotiating even when issues get a bit difficult. A lot better than a Court room.

What a great concept! And hopefully that co-operation can continue even when the lawyers have gone.

    Speak with you later
